Adidas America Inc. and Elan Polo Inc. settled a trademark lawsuit over whether an Elan Polo shoe infringed Adidas’ three-stripe design.

Adidas America Inc. and Elan Polo Inc. settled a trademark lawsuit over whether an Elan Polo shoe infringed Adidas’ three-stripe design.

Elan Polo asked a federal judge to rule the shoe didn’t infringe on the trademark so it could continue selling the product to Walmart. Walmart had sold the shoe since at least December 2012, according to Elan Polo.

In a counter-lawsuit, Adidas said the disputed shoe is “confusingly similar” to the Adidas three-stripe design.
