But the company who was in charge of the Iraqi oil refinery, KBR Inc., is fighting the ruling.

In the course of the trial, observers learned that KBR’s contract to restore the flow of Iraqi oil included an indemnification clause intended to shield KBR from liability stemming from its activities in the war zone.
But when KBR asked the Army Corps of Engineers to reimburse it for its legal costs in defending itself in cases in Oregon and Texas, the Corps disagreed that the costs qualified for reimbursement under the contract.
